NOTICE UNDER ART. 13 OF LEGISLATIVE DECREE NO. 196 OF JUNE 30 2003 AND FOR THE PURPOSES THEREOF

(PERSONAL DATA PROTECTION CODE)

The information appearing below is provided under art. 13 of Legislative Decree no. 196 of June 30 2003, known as the “Personal Data Protection Code” (or as the “Privacy Code”) to users who make use of the services accessible at the web address http:/www.eliosceramica.com (the “Site”). Consultation of the Site may in fact result in collection of information on users which is considered personal data under the Privacy Code. This notice is provided exclusively for this Site and does not apply to any other web sites users may access through link present on the Site.

DATA CONTROLLER AND DATA PROCESSOR

The Data Controller is Elios Ceramica S.p.A. (“Elios” or the “Company”), with registered offices at Via Giardini 60, 41042 Fiorano Modenese (MO), Italy. SITE OF DATA PROCESSING

Processing of data linked with web services on this Site takes place in Elios’s offices, at the location identified above, and is performed by people duly appointed as Persons in Charge of the Processing, and by external technicians appointed as Data Processors in the case of maintenance and management operations.

NATURE OF THE DATA PROCESSED

BROWSING DATA

The information systems and software procedures used in operation of this Site acquire, in the course of their regular operations, certain items of personal data, the transmission of which is implicit in use of Internet communication protocols.

This information is not collected for association with identifiable persons, but could, due to its very nature, potentially permit identification of users through processing and association with data held by third parties.

This category of data the includes IP addresses or domain names of computers used by users to connect to the Site, addresses of requested resources in URI (Uniform Resource Identifier), the time of the request, the method used to submit the request to the server, the size of the file obtained in response, the numerical code indicating the status of the server’s response (successful, error, etc.) and other parameters regarding the user’s operating system or IT environment.
The data will be used solely to obtain anonymous statistical information on use of the Site and ensure that it is working properly, and is deleted immediately after processing. The data may be used to ascertain responsibility in the event of IT crimes damaging the Site, but other than in this case, data on web contacts is kept only for a maximum of one month.

DATA SUPPLIED VOLUNTARILY BY USERS

Optional, explicit, voluntary sending of e-mail to the addresses identified in this Site and filling in of specially designed forms will result in acquisition of the e-mail address and possibly of other personal data included in the e-mail, as well as data identifying the sender/user, necessary to respond to the request or provide the service.

COOKIES – GOOGLE ANALYTICS TECHNICAL DATA

Cookies are text strings (“data files”) which some web sites may send users who are visiting them in order to track their movements within the site and collect data in anonymous form in order to improve the contents and ease of use of the site.

The Site uses technical cookies only to make browsing possible and allow users to make use of all its functions. PURPOSES OF DATA PROCESSING

The data collected (name, surname, e-mail address, province of residence, topics of interest, etc.) and e-mail address will be processed in order to respond to requests received or to send a newsletter by e-mail on the Company’s field of business, and to send updates on new offers or content in the internet site www.eliosceramica.com and the social channels on which it is represented.

DATA PROCESSING METHODS

Data is processed using procedures and tools suitable for guaranteeing its security and confidentiality, and may be processed in printed form or with use of electronic aids. Information is retained only for the amount of time strictly necessary to achieve the goals for which it was collected, and in all cases, will not be retained if the data subject objects.

Specific security measures have been adopted to prevent loss of data, unlawful or incorrect use and unauthorised access.

OBLIGATORY OR OPTIONAL NATURE OF PROVIDING DATA AND CONSEQUENCES OF REFUSAL TO DO SO

Providing data is optional, and refusal to provide it will not have any consequences other than failure to provide some or all services.

9) COMMUNICATION AND DISCLOSURE

The information collected may be communicated in the following ways:

  • to parties duly appointed as Persons in Charge of the Processing within our organisation for processing of the data, particularly in the marketing and sales office,
  • to subjects who may access the data under laws or EU regulations, to the extent permitted by the law;
  • to third parties providing services which are accessory or instrumental to the work of Elios and have been appointed as Data Processors (such as maintenance technicians);
  • to our consultants, to the extent required for them to do their work for us, after providing them with a letter of appointment which requires them to maintain data confidentiality and security.

Other than these cases, the data will not be communicated, except where necessary to respond to requests of court authorities or public security officials. The data collected will in no case be disclosed.

10) DATA SUBJECTS’ RIGHTS

Under art. 7 of the Privacy Code, personal data subjects are entitled to obtain confirmation of the existence or absence of data on them at any time, and to determine its content and origin, check its accuracy, or request that it be integrated, updated or corrected. Under the same article, data subjects are entitled to request deletion, transformation into anonymous form, or freezing of data which has been processed in violation of the law, and to object to its treatment in all cases with legitimate reason. Requests should be sent – without any procedural formalities – to the Data Processors at the addresses listed above.
